The terms and conditions specified herein are a legal contract between you (the
"User" or "you") and Kotak Mahindra Old Mutual Life Insurance Ltd ("Kotak Life Insurance",“we” or “us”) for the use of this web site (www.kotaklifeinsurance.com) which is
owned and operated by Kotak Life Insurance (the " Kotak Life Insurance Web Site").
In consideration of User being given access to the Kotak Life Insurance Web Site,User agrees to be bound by these terms and conditions of use (the "Terms"). By accessing
or using the Kotak Life Insurance Web Site,you are acknowledging that you have
read,understood,and agree,without limitation or qualification,to be bound by
these Terms.

THAT BY CLICKING ON THE "I AGREE" BUTTON,YOU ARE AGREEING TO BE BOUND BY ALL OF
THE TERMS & CONDITIONS OF KOTAK LIFE INSURANCE WEB SITE
Anyone (existing/prospective customer) can create a login id and password for himself/herself
and can access all the marketing related information,chat rooms etc only.
Only existing policy holders can register their policies.
Customer’s policy gets registered for view rights based on inputs from customer
and validation from back end.
Once validated,the policy owner/customer gets only view rights on all policies
where he is the policy owner (other policies where he is the policy owner automatically
gets attached to his user id-password)
Incase the policy owner needs transaction rights,he would need to download the
policy registration form,sign the same and submit it with KLI for verification.
The form will be verified by the centralized PS team in Mumbai and transaction rights
will be granted to the customer.
Once the customer is verified and is given transaction rights,he can request for
all service requests through the portal (Increase/Decrease SA,Riders,Revivals,Name change etc)
While we do accept the requests online,the processing will be offline and the same
will go through the normal existing back end process (verification/underwriting
wherever required).
Requests for services through portal can either be couriered to us or uploaded through
the portal directly as the case may be. No risk implications as “surrender” requests
will be entertained thru this online services.
Proposal/policy status will only be available for existing customers. However,the
prospective customers will only have a login and no access to proposal details.
TRANSACTION RIGHTS:

Login User-id and password can be obtained by registering
on KLI's web-site as new users.

You should submit the duly completed Transaction Rights
Request Form at any KLI branch where your policy is being presently serviced.

Transaction rights on the policies will be available
to you only after the Transaction Rights Request Form is validated. You can get
transaction rights on only those policies for which you are an authorised signatory/claimant.

If you believe that any information relating to your
account has a discrepancy,please bring it to the notice of the KLI by e-mail or
letter.

KLI reserves the right to reject/disqualify any registration
/ transaction rights request at its own discretion.
-
KLI reserves the right to modify the services offered
or the Terms of service of KLI's web-site. The changes will be notified to You /
Users through a notification on the website.

The policyholder has an obligation to maintain secrecy
in regard to the user-id and password allotted by KLI and KLI presupposes that login
using the user-id and password is a valid session initiated by none other than the
policyholder.

Transaction executed through a valid session will
be construed by KLI to have emanated from the registered policyholder and will be
binding on him / her.

The policyholder will not attempt or permit others
to attempt accessing the KLI's web-site through any unlawful means.
THESE (TRANSACTION RIGHTS) TERMS AND CONDITIONS SHALL
BE READ ALONG WITH THE OTHER TERMS AND CONDITIONS GOVERNING THIS WEBSITE AND SPECIFIED
HEREIN.
GENERAL TERMS AND CONDITIONS:

Accuracy of Information:
The User is responsible for the correctness of information supplied to Kotak Life
Insurance from time to time. If the User has reason to believe that there is an
error in the information furnished to Kotak Life Insurance,he / she shall immediately
advise Kotak Life Insurance in writing. Kotak Life Insurance shall not be liable
for any consequences arising out of erroneous or misleading,incorrect,untimely
or incomplete information furnished by the User.

permitted by applicable law,Kotak Life Insurance does not warrant that the content

The User further agrees that Kotak Life Insurance may hold and process his personal

disclose in strict confidence to other institutions such personal information may
be necessary for reasons inclusive but not limited to (i) participation in any telecommunication
or electronic clearing network (ii) in compliance with a legal or regulatory directive/instruction
(iii) for fraud prevention purposes.

Representation and
Warranties of the User :
The User represents and warrants that (i) he / she has the authority and/or he /
she is lawfully entitled to accept the Terms and that he / she is not under any
disability,restriction or prohibition which shall prevent him from performing or
adhering to any of his obligations under the Terms;(ii) the execution of the Terms
or any part therein is not,directly or indirectly,in conflict with any other agreement
or document that the User has executed or entered into;(iii) there are no liabilities
against,relating to or affecting the User,which individually or in aggregate,are material to the business of Kotak Life Insurance;(iv) the personal information
provided by the User to Kotak Life Insurance at the time of registration is true
and accurate and any other information provided thereafter shall be true and accurate;(v) there are no legal proceedings,or injunctive or stay orders pending against
or likely to arise against the User that may violate the Terms or materially affect
the User's fulfillment of these Terms.
- Electronic Communication
Disclaimer:
The information contained in electronic communication sent from Kotak Life Insurance
Web Site / domain and any attachments thereof is confidential and may be privileged.
If electronic communication is either intentionally or inadvertently misdirected
to an individual or group other than the indicated recipient,such electronic communication
should be deleted.

Insurance be liable for any damages,direct,indirect,incidental,and/or consequential,including without limitation special damages,economic loss,loss of profits,loss
of business opportunity,loss of data or data use,bodily injury,emotional distress
or discomfort,or physical damage resulting from or in any way related to your use
of the Kotak Life Insurance Web Site,including but not limited to your use,reference
to or reliance on any information obtained on or through this site. If any provisions
of this clause are unenforceable under the laws of a particular jurisdiction,this
clause will be enforced to the extent permitted under the laws of that jurisdiction.

such claims. You agree to cooperate with us as reasonably required in the defense
of any such claims. Kotak Life Insurance reserve the right,at their own expense,to assume the exclusive defense and control of any matter otherwise subject to indemnification
by you,and you shall not in any event settle any such claim or matter without the

Nothing in this Agreement is intended,nor will it be construed as,an attempt to
exclude or limit liability for death or personal injury caused by negligence.
- Indemnification

You specifically agree to defend,indemnify and hold Kotak Life Insurance,its parents,subsidiaries,affiliates,directors,officers and employees harmless for any loss,claim,demand,or damage(s) or costs,including reasonable attorneys' fees,resulting
from any third party claim,action,or demand resulting from your use of the Kotak

to indemnify Kotak Life Insurance for any loss,damages,or costs,including reasonable

totally accountable for all actions that take place in your membership account.
It is entirely your responsibility to maintain the confidentiality of your password
and user id and also to inform Kotak Life Insurance without delay of any dishonest,unauthorized or illegal use of your account,we request you to call at the number
as stated in clause 36.

as per any local,state,national and international laws in force and are wholly
responsible for all actions or lapses that take place through your membership account

Kotak Life Insurance immediate and irreparable harm for which money damages may
not constitute an adequate remedy. You further agree that injunctive relief,in
addition to any other remedies available,may be warranted in order to enforce these

Web Site may expose you to civil and criminal liability and that we may report violations
of these Terms of Use to and cooperate fully with the appropriate law enforcement

In addition to any other remedy available,You agree and acknowledge that in the

Materials,then you shall be liable to Kotak Life Insurance for liquidated damages
in the amount of Rs. ____________/- per violation. In no event shall liability for
liquidated damages preclude liability for consequential damages or any other remedy.
- Force Majeure :
Notwithstanding anything to the contrary contained herein,nothing herein shall
apply if Kotak Life Insurance is prevented from discharging any or all of its obligation
herein or otherwise due to any cause arising out of or related to Force Majeure
or for any reasons beyond the reasonable control of Kotak Life Insurance.
- Arbitration:
With respect to any dispute regarding the Kotak Life Insurance Web Site,Your rights
and obligations and all actions contemplated by these Terms shall be governed by
the laws of Republic of India,as if the Terms were a contract wholly entered into
and wholly performed within India. Any dispute relating in any way to your visit
to the Kotak Life Insurance Web Site shall be submitted to confidential arbitration
in India,except that,to the extent you have in any manner violated or threatened
to violate our intellectual property rights,we may seek injunctive or other appropriate
relief in the appropriate Court and you consent to exclusive jurisdiction and venue
in such courts. Arbitration under this Agreement shall be conducted under the rules
then prevailing of the Arbitration and Conciliation Act,1996. The arbitrator's
award shall be binding and may be entered as a judgment in any court of competent.
The venue of arbitration proceedings shall be at Mumbai.
- Governing Law:
This agreement is governed by the laws of India. You hereby consent to the exclusive
jurisdiction of the Mumbai courts in all disputes arising out of or relating to
the use of this Kotak Life Insurance Web Site. Use of this Kotak Life Insurance
Web Site is unauthorised in any jurisdiction that does not give effect to all provisions
of these Terms of Use,including without limitation this paragraph.
- Amendment of Terms:
The User acknowledges and agrees that Kotak Life Insurance may at its sole discretion add to,modify or amend the Terms (including the Charges) from time to time and such changes shall be communicated to the User,but individual communication may not be sent to him.
Kotak Life Insurance may publish notices of general nature,which are applicable to the User on Kotak Life Insurance Website or on its notice board or in any other mode
as may be decided by Kotak Life Insurance. Such communication and notices would have the same effect as a notice served individually to each Customer.
Unless otherwise specified,such changes shall be effective upon posting. User has the obligation to review changes in these Terms.
User's continued use of the Kotak Life Insurance Web Site constitutes User's agreement to be bound by such changes to these Terms.
We may,with or without prior notice,terminate any of the rights granted by these Terms.
You shall comply immediately with any termination or other notice,including,as applicable,by ceasing all use of the Kotak Life Insurance Web Site.
- Relationship:
You acknowledge that no joint venture,partnership,employment,or agency relationship
exists between you and Kotak Life Insurance,as a result of your use of this Kotak
Life Insurance Web Site. You agree not to hold yourself out as a representative,agent or employee of Kotak Life Insurance and that Kotak Life Insurance will not
be liable by reason of any representation,act or omission to act by you.
